  1. In order to submit a notice of IP infringement, you must either be the rights holder of the reported IP or an authorized agent granted permission by the rights holder to file notices on their behalf.


  1. Upon receipt of your report, we will conduct a thorough investigation into the listings or content in question. Please be aware that any report submitted to us must be done so in good faith and sworn under penalty of perjury.


  1. Submission of a notice through our online Intellectual Property Infringement Report Portal ("IP Portal") requires the notifier to be logged in. Your report should include the following details:


    Clear identification of the infringed IP, including registration number, detailed description of copyrighted work, link to copyrighted material, and initial date of use or publication.Description of the nature of infringement, specifying whether it pertains to the product itself, physical packaging, images, or text on product detail pages.List of URLs for the infringing products' detail pages.Identification of the parties engaged in the infringement.Any supporting documentation or pertinent information aiding in the processing of your complaint, such as order IDs for test purchases of the reported products.Your contact information, including name, address, phone number, and email address.Any additional information mandated by applicable laws.(4) We reserve the right to request further information before proceeding with the report, which may include verification or documentation confirming the claimed rights and ownership.

  1. If you are the copyright owner or authorized to represent the owner of a copyright allegedly infringed upon, you may submit a notice of infringement via the IP Portal. This notice must contain the following details:


    • The physical or electronic signature of an individual authorized to act on behalf of the exclusive rights holder purportedly infringed upon.


    • Identification of each copyrighted work claimed to be infringed, which may encompass multiple copyrighted works.


    • Identification of each infringing material to be removed or access to which should be disabled, along with sufficient information to locate such material.


    • Contact information allowing us to reach you, including your address, telephone number, and email address.- A statement affirming your good faith belief that the use of the material in question is not authorized by the copyright owner, their agent, or applicable law.


    • A declaration confirming the accuracy of the information provided in the notice and asserting, under penalty of perjury, your status as the copyright owner or authorized representative.


  1. Misrepresentation of material as infringing may result in liability for damages. Therefore, if uncertainty exists regarding whether material is infringing, it is advisable to seek legal counsel before submitting a notice to us.


  1. Upon acceptance of your infringement notice, we will remove the reported content and undertake suitable action against the responsible parties. Details of actions taken are not disclosed unless already public.


  1. Repeat infringer policy: We are dedicated to safeguarding intellectual property rights and will terminate accounts of repeat infringers when warranted.

  1. Should the content provider believe that the removed material (or material to which access was disabled) is not infringing, or was authorized for use, they may submit a counter-notice to us, including the following details:


    • A physical or electronic signature of the content provider.


    • Identification of the material that was removed or disabled, along with its previous location before removal or disabling.


    • A statement, under penalty of perjury, asserting that the content provider holds a genuine belief that the removal or disabling was due to a mistake or misidentification of the material.


    • Contact information of the content provider, including name, address, telephone number, and email address. Additionally, a statement consenting to the jurisdiction of the Federal District Court where the content provider resides, or if outside the United States, any district where Whaleco Inc. operates, and agreeing to accept service of process from the notifier of the alleged infringement.


  1. Upon receipt of a counter-notice, we will proceed in accordance with the Digital Millennium Copyright Act (DMCA) by taking appropriate actions.

Retract a Report

Retract a Report

The intellectual property owner or their authorized agent, who initially reported infringement, can retract their report via the IP Portal. The withdrawal request must distinctly identify the previously submitted report by providing details of the complaining party, the specific intellectual property right that was claimed to have been infringed, and the material that was the subject of the complaint and is now to be withdrawn.
